This Privacy Policy explains what we collect, including through business, individual asset owner, and professional verification, KYC checks, and AI-assisted search, how we use it, and the rights you have over your information.
1 Information We Collect
1.1 Information You Provide
We collect information you voluntarily provide when you:
- Create an account or contact us: Name, email address, phone number, physical address, and message content
- Apply to join as a business: Business name, category, registration and years in business, description, website, county, address, and contact person details
- Apply as an individual asset owner: Name, national ID or passport number, contact details, asset type and description, location, and proof of ownership information
- Apply as a professional service provider: Name, national ID or passport number, contact details, qualifications, professional/regulatory registration number, practising status, and experience information
- Submit verification documents: Registration certificates, CR1/CR2/CR8/CR12, KRA PIN and tax compliance certificates, business permits, professional licences and practising certificates, title deeds, lease agreements, official land or survey search results, vehicle logbooks, national ID/passport, and other credentials requested for your category
- Complete KYC verification: Identity documents and related information where required for you, as a customer or transaction participant, to take part in a qualifying high-value or escrow transaction
- Search using AI: The natural-language queries you type into the AI search bar (e.g. "warehouse near JKIA")
- Send an inquiry: Your name, phone number, email, and the listing or service you're interested in
1.2 Information Collected Automatically
When you use the Platform, we automatically collect:
- Device information: IP address, browser type, operating system, device identifiers
- Usage data: Pages visited, time spent, links clicked, search and filter activity
- Approximate location: Derived from your IP address, used to bias search results toward your region
- Cookies and similar technologies: Session information, preferences, analytics data
2 How We Use Your Information
We use collected information to:
- Operate the platform: Display verified listings, process business, individual asset owner, and professional applications, and connect customers with verified participants
- Verify and authenticate: Review submitted documents, confirm identity and ownership, cross-check information against official registries where applicable, assess risk and assign a verification level, coordinate physical/site verification or independent professional due diligence where required, and prevent fraudulent listings
- Conduct KYC checks: Verify the identity of customers and other transaction participants where required for a qualifying high-value or escrow transaction
- Power AI search: Interpret your natural-language queries to extract sector, location, budget, and other criteria, and rank verified results accordingly
- Communicate: Respond to inquiries and applications, send account or verification updates, and provide customer support
- Improve the Platform: Analyze usage patterns, evaluate AI search performance, and develop new features
- Send updates (with consent): Newsletters and notifications about new verified businesses, where you've opted in
- Comply with the law: Meet legal obligations, resolve disputes, and enforce our Terms
- Maintain security: Detect and prevent fraud, abuse, and unauthorized access
3 AI Processing & Automated Matching
AgileSoko's AI search feature is powered by a third-party large language model provider. When you submit a search query, the text of that query is sent to our AI provider to extract structured search criteria (such as sector, location, or budget), which we then use to filter and rank verified listings stored in our database.
Business verification decisions are made by AgileSoko's verification team, not by AI alone. AI is used to assist discovery and ranking, not to make final decisions that produce legal or similarly significant effects about you.
4 How We Share Your Information
4.1 With Businesses You Contact
When you submit an inquiry about a listing or service, your name, phone number, email, and message are shared with the relevant verified business, individual asset owner, or professional so they can respond to you.
4.2 With Our Verification Team
Documents and information submitted with an application are shared internally with AgileSoko's verification staff, and are not made public. Only your verification status and profile (not your underlying documents) appear on public listings.
4.3 With Official Registries & Independent Professionals
Where applicable to your category and verification level, we may share relevant information with official registries and government systems (such as the Business Registration Service or the relevant Land Registry) to independently verify what you've submitted, and with independent qualified professionals (such as advocates, surveyors, or valuers) engaged to carry out enhanced due diligence, physical verification, or KYC checks for a qualifying transaction. These parties use your information only for the specific verification or due diligence purpose for which they were engaged.
4.4 With Service Providers
We share data with trusted third parties who help us operate the Platform, including our database and hosting provider (Firebase/Google Cloud), our AI search provider, analytics tools, and communication tools such as WhatsApp.
4.5 Legal Requirements
We may disclose information when required by law or legal process, or to protect the rights, property, or safety of AgileSoko, our users, or the public.
5 Data Security
We implement security measures to protect your information, including:
- Encryption: Data transmitted over secure HTTPS connections
- Access controls: Verification documents are accessible only to authorized verification staff
- Vendor security: We rely on reputable infrastructure providers (Google Firebase) with their own security safeguards
No method of transmission over the internet is completely secure. While we work to protect your data, we cannot guarantee absolute security.
6 Your Rights
Under Kenya's Data Protection Act, 2019, and applicable data protection law, you have the right to:
- Access: Request a copy of the personal data we hold about you
- Correction: Request correction of inaccurate or incomplete data
- Deletion: Request deletion of your personal data, subject to legal or verification-record obligations
- Restriction: Request that we limit processing in certain circumstances
- Objection: Object to processing based on legitimate interests, or to direct marketing
- Withdraw consent: Withdraw consent at any time where processing relies on it
- Lodge a complaint: With Kenya's Office of the Data Protection Commissioner, if you believe your rights have been violated

7 Cookies & Tracking Technologies
Cookies are small text files stored on your device that help us provide and improve the Platform. We use:

8 Data Retention
We retain account and inquiry data for as long as needed to provide the Platform and meet legal obligations. Verification documents, including business, individual asset owner, and professional credentials, KYC records, and records of any physical verification or independent professional due diligence, are retained for the duration of an active verified status and for a reasonable period afterward to meet compliance and audit needs, after which they are securely deleted or anonymized.
9 Children's Privacy
AgileSoko is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected such information, we will promptly delete it.
10 Changes to This Policy
We may update this Privacy Policy periodically to reflect changes in our practices, technology (including our AI search provider), or legal requirements. Material changes will be noted on this page. Continued use of the Platform after changes are posted constitutes acceptance of the updated policy.
